Libraries cannot preserve digital material they do not own. Adrienne Muir describes a new project to identify copyright and licensing issues that currently hinder digital preservation and looks at whether new legislation will help.

National Library of New Zealand - Digital Collections
The National Digital Archive of Datasets (NDAD) is part of The National Archives. NDAD preserves and provides online access to archived digital data and documents from UK central government departments.
The Digital Preservation Coalition (DPC) was established in 2001 to foster joint action to address the urgent challenges of securing the preservation of digital resources in the UK and to work with others internationally to secure our global digital memory and knowledge base.
LACA is The Library Association Copyright Alliance which is the main UK body lobbying for the library, information and archive professions and their users for fair practices in copyright. Its aims are:
to act as an expert body providing advice and guidance to the sector and to other relevant bodies;
to monitor changes in copyright legislation affecting the sector;
to encourage and lobby the UK and EU governments to make fair and balanced copyright laws;
to work closely with other UK and international consumer groups on copyright;
to promote respect and understanding of copyright among the library, information and archive community.

Statement from leading US libraries on Fair Use in the Electronic Age.
Without infringing copyright, the public has a right to expect:- to read, listen to, or view publicly marketed copyrighted material privately, on site or remotely;
- to browse through publicly marketed copyrighted material;
- to experiment with variations of copyrighted material for fair use purposes, while preserving the integrity of the original;
- to make or have made for them a first generation copy for personal use of an article or other small part of a publicly marketed copyrighted work or a work in a library’s collection for such purpose as study, scholarship, or research; and
- to make transitory copies if ephemeral or incidental to a lawful use and if retained only temporarily.
Without infringing copyright, nonprofit libraries and other Section 108 libraries, on behalf of their clientele, should be able:- to use electronic technologies to preserve copyrighted materials in their collections;
- to provide copyrighted materials as part of electronic reserve room service;
- to provide copyrighted materials as part of electronic interlibrary loan service; and
to avoid liability, after posting appropriate copyright notices, for the unsupervised actions of their users.
